Disclaimer and Safety Guidelines

IMPORTANT: By using this Product, you signify that you have read, understood, and agreed to these terms. If you do not agree to these terms, you may not use the Product.

1. GENERAL DISCLAIMER & WARRANTY


 1.1 "As-Is" Basis To the maximum extent permitted by law, the Product, Software, and Services are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, either express or implied. Ceres Air disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.

1.2 No Guarantee of Error-Free Operation The Manufacturer does not warrant that the Product will be uninterrupted, secure, or free of errors, viruses, or other harmful components. You acknowledge that accidents may occur due to factors such as improper operation, environmental conditions, and communication network failures, and that such accidents are considered reasonable and acceptable risks assumed by the user.

2. LIMITATION OF LIABILITY


2.1 Liability Cap Under no circumstances will the Manufacturer be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, goodwill, or data).

Maximum Liability: The Manufacturer’s aggregate liability to you for all claims is strictly limited to the amount you paid to purchase the product. In cases involving non-purchase disputes (e.g., website use), liability may be limited to $100.

2.2 User Responsibility You are solely responsible for any personal injury, death, damage to your property (including the drone and mobile device), or damage to third-party property that results from your use of the Product.

3. ELIGIBILITY AND COMPLIANCE


3.1 Age and Competence

Age Restriction: The Product is not a toy. It is not suitable for individuals under the age of 16. For product activation and entering binding contracts, you represent that you are at least 18 years of age.

Certification: For agricultural operations, you pledge that you have completed required drone pilot training and obtained the necessary UAS operator certificates mandated by local laws.

3.2 Lawful Use You agree to comply with all local laws and regulations regarding flight height, flight areas (Geofencing), and visual line of sight. You must not use the Product for combat purposes or any illegal activities.

4. SAFETY GUIDELINES


4.1 Pre-Flight Inspections Before every flight, you must ensure:

• All parts (propellers, motors, landing gear) are intact, clean, and free of cracks or damage.

• Propellers are securely installed and fully spread out.

• Firmware and App versions are up to date.

• Batteries are sufficiently charged. If the battery level drops below 20% during operation, you must return the drone immediately.

4.2 Environmental Restrictions Do NOT operate the drone in the following conditions:

Adverse Weather: Rain, snow, fog, hail, thunder, dust storms, or winds exceeding Force 3.

Interference: Areas with strong electromagnetic interference (e.g., high-voltage lines, radio towers, base stations).

Obstacles: Indoors or near crowds, animals, or buildings. You must maintain a safety radius (e.g., 10 meters) from people during takeoff and landing.

4.3 Pesticide and Chemical Safety (For Agricultural Models)

Protective Gear: You must wear protective equipment (masks, goggles, rubber gloves) when handling pesticides.

Environmental Protection: You are prohibited from polluting rivers and drinking water sources.

Filtration: Pesticides must be mixed with clean water and filtered to prevent clogging; do not use muddy or dirty water.

4.4 Operational Prohibitions You agree NOT to:

• operate the product while under the influence of alcohol, medication, or anesthesia;

• override flight safety features, geo-fencing systems, or maximum flight height limitations;

• "hack," "crack," or reverse engineer the product software or source code;

• touch spinning propellers or motors, which pose a severe injury risk.

5. DATA PRIVACY AND TRANSMISSION


You understand and accept that the Product is a "connected product." Flight records, operation data, and telemetry may be automatically uploaded and saved to the Manufacturer’s servers.

Data Loss: The Manufacturer assumes no responsibility for data loss if you fail to sync or upload your flight records.

• EU Data Rights: Users in the EU have specific rights to access, retrieve, and erase data generated by the product, subject to trade secret protections.

6. INDEMNIFICATION


You agree to defend, indemnify, and hold harmless Ceres Air from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising out of your use of the Product, your violation of these Terms, or your violation of any third-party rights.

7. DISPUTE RESOLUTION


7.1 Binding Arbitration All disputes between you and the Manufacturer will be resolved by binding individual arbitration. You explicitly waive your right to a trial by jury or to participate in a class action lawsuit.

Governed by the laws of the State of Delaware
